1. Agreement and license
By downloading or using Gutcast, you agree to these terms, our Privacy Policy, and Apple’s Standard End User License Agreement (“Apple EULA”). If these terms conflict with the Apple EULA, the Apple EULA controls where required.
Gutcast is licensed, not sold, to you for personal, non-commercial use on Apple-branded devices you own or control, subject to the App Store rules and the Apple EULA.
2. Wellness disclaimer
Gutcast identifies patterns between food and how you report feeling. It is provided for general wellness and informational purposes only. Gutcast does not provide medical advice and does not diagnose, treat, cure, or prevent any disease or condition.
Meal analysis, ingredient identification, risk windows, Gut Scores, and Trigger Board results are estimates and may be incomplete or inaccurate. Do not rely on Gutcast for emergency decisions, allergy safety, or decisions that require medical judgment. Seek advice from a qualified healthcare professional for medical concerns.
3. Subscriptions and billing
Some features may require an auto-renewing Gutcast Pro subscription. Price, billing period, and any free-trial terms are shown in the App Store purchase screen before you confirm. Payment is charged to your Apple Account.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel in iPhone Settings → Apple Account → Subscriptions. Refunds are handled by Apple under Apple’s policies and applicable law.
4. Acceptable use
You agree not to:
- use Gutcast unlawfully or to violate another person’s rights;
- upload content you do not have the right to use;
- attempt to bypass security, access another person’s data, or disrupt the service;
- reverse engineer or redistribute Gutcast except where applicable law permits; or
- use automated systems to abuse, overload, or probe the service.
5. Your content
You keep ownership of meal photos and other content you submit. You give us a limited license to host, process, and transmit that content only as needed to provide, secure, and improve Gutcast. You are responsible for the content you submit.
6. Changes and availability
We may update, add, or remove features, or suspend part of the service for maintenance, security, legal, or operational reasons. We do not guarantee uninterrupted or error-free availability. We may end your access for material violations of these terms, subject to applicable law.
7. Disclaimers and liability
To the fullest extent permitted by law, Gutcast is provided “as is” and “as available.” We disclaim implied warranties that may lawfully be disclaimed. Nothing in these terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss arising from your use of Gutcast. Our aggregate liability for claims relating to Gutcast will not exceed the greater of the amount you paid for Gutcast in the prior 12 months or AUD $100, except where law does not permit that limitation.
8. Governing law
These terms are governed by the laws of Queensland, Australia, without limiting any mandatory consumer rights that apply where you live.
